1. Agreement to These Terms
These Terms of Use ("Terms") govern your access to and use of Arc, including its iOS application, website, and all related services (collectively, the "Service"). By downloading, installing, or using Arc, you agree to be bound by these Terms. If you do not agree, do not use the App.
These Terms form a legally binding agreement between you and Arc. Please read them carefully.
2. The App and Your Licence
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to download and use Arc on Apple devices that you own or control, solely for your personal, non-commercial purposes.
This licence does not include the right to:
- Sublicense, sell, resell, transfer, assign, or commercially exploit the App or any part of it.
- Modify, adapt, translate, reverse-engineer, decompile, disassemble, or create derivative works based on the App.
- Remove, alter, or obscure any copyright, trademark, or other proprietary notices within the App.
- Use the App to build a competing product or service.
Arc is available on the Apple App Store. Your use of the App is also subject to Apple's Standard End User Licence Agreement.
3. Accounts
3.1 Creating an Account
You must create an account to use most features of Arc. You may sign in using Apple Sign In. You agree to provide accurate information and keep your account details up to date.
3.2 Account Security
You are responsible for maintaining the security of your Apple ID and for all activities that occur under your Arc account. If you suspect unauthorised access, contact Apple to secure your Apple ID and notify us at info@nocap.bio.
3.3 Account Termination by You
You may delete your account at any time from Settings → Delete Account within the App. Deletion permanently removes all your account data from our servers. If you have an active subscription, cancelling your account does not automatically cancel your subscription — you must do this separately through your Apple ID settings.
3.4 One Account per Person
Accounts are personal and may not be shared with or transferred to another person.
4. Pro Subscriptions & Purchases
4.1 Available Plans
Arc offers two paid plans that unlock Pro features (including watermark-free exports and premium widgets):
- Weekly Pro — an auto-renewing weekly subscription billed through Apple.
- Lifetime Pro — a one-time purchase that grants permanent access to Pro features.
Current pricing is displayed in the App and may vary by region and currency. All prices include applicable taxes where required.
4.2 Billing & Renewal
The Weekly Pro subscription renews automatically at the end of each billing period unless cancelled at least 24 hours before the renewal date. Your Apple ID will be charged upon confirmation of purchase and at the start of each renewal period. Apple manages all billing; we do not collect or store payment card information.
4.3 Free Trial
Where offered, a free trial converts automatically to a paid subscription at the end of the trial period unless cancelled beforehand. Cancellation during a trial prevents any charge.
4.4 Cancellation
You may cancel a subscription at any time through Settings → [Your Name] → Subscriptions on your iPhone. Cancellation takes effect at the end of the current billing period; you retain Pro access until that date. Cancellation does not entitle you to a refund for the current period.
4.5 Refunds
All purchases are processed by Apple and subject to Apple's refund policies. To request a refund, visit reportaproblem.apple.com. We do not process refunds directly.
4.6 Price Changes
We may change subscription prices from time to time. We will notify you of any price increase before it takes effect, and you will have the opportunity to cancel before the new price applies.
4.7 Feature Availability
Pro features are subject to change. We reserve the right to modify, add, or remove features. We will not remove core Pro functionality without reasonable notice.
5. Health Data Disclaimer
Arc displays workout metrics sourced from Apple Health, such as heart rate, calories, pace, and VO₂ Max estimates. This information:
- Is not medical advice and should not be used to diagnose, treat, cure, or prevent any health condition.
- May be inaccurate, as it depends on the quality of data recorded by your Apple Watch, iPhone, or connected sensors.
- Should not replace professional medical consultation, diagnosis, or treatment.
Always consult a qualified healthcare professional before making decisions about your health, exercise routine, or medical treatment. If you experience symptoms such as chest pain, dizziness, or shortness of breath during exercise, stop immediately and seek medical attention.
6. User Content & Exports
6.1 Your Content
Photos you import and widget images you create within Arc remain your property. We do not claim any ownership over images you create or export using the App.
6.2 Your Responsibility
You are solely responsible for the content you create and share using Arc. By exporting or sharing content, you represent that you have all necessary rights to that content and that sharing it does not violate any applicable law or third-party rights (including copyright, privacy, or personality rights).
6.3 Free Plan Watermark
Exports on the free plan include an Arc watermark. Removing the watermark programmatically or by editing the exported image without a valid Pro subscription is a violation of these Terms.
6.4 Font Licences
Some display fonts available within Arc are licensed for personal use only. By using the App, you agree to use those fonts solely within the App for personal, non-commercial purposes. Commercial use of personal-use-only fonts via Arc exports is your responsibility.
7. Acceptable Use
You agree not to use Arc to:
- Violate any applicable local, national, or international law or regulation.
- Infringe the intellectual property rights of any third party.
- Create or distribute content that is defamatory, obscene, hateful, discriminatory, or otherwise harmful.
- Attempt to gain unauthorised access to any part of the App or its underlying infrastructure.
- Interfere with or disrupt the integrity or performance of the App or its servers.
- Reverse-engineer, decompile, or extract the source code of the App.
- Use automated scripts, bots, or tools to interact with the App.
- Misrepresent your identity or impersonate any person or entity.
8. Intellectual Property
All rights, title, and interest in and to Arc — including its design, code, graphics, logos, widget templates, and all other content we create — are and remain the exclusive property of Arc and its licensors. Nothing in these Terms transfers any such intellectual property rights to you.
The "Arc" name and logo are trademarks of the App's developer. You may not use these marks without our prior written permission.
9. Third-Party Services
Arc integrates with third-party services including Supabase, RevenueCat, Apple HealthKit, Apple Sign In, and Instagram (for optional sharing). Your use of these services is subject to their respective terms and policies. We are not responsible for the practices or content of third-party services.
Links to third-party websites or services are provided for convenience only and do not imply endorsement.
10. Disclaimer of Warranties
Arc is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted or error-free operation.
We do not warrant that:
- The App will always be available, uninterrupted, or free of errors.
- Defects will be corrected.
- The App or its servers are free of viruses or other harmful components.
- Results obtained from the App will be accurate or reliable.
Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.
11. Limitation of Liability
To the maximum extent permitted by applicable law, Arc and its developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, goodwill, or other intangible losses — arising out of or in connection with your use of, or inability to use, the App, even if advised of the possibility of such damages.
In no event shall our total aggregate liability to you for all claims relating to the App exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) USD $10.
Some jurisdictions do not allow the limitation of certain damages, so some of the above limitations may not apply to you.
12. Termination
12.1 Termination by You
You may stop using Arc and delete your account at any time.
12.2 Termination by Us
We may suspend or terminate your access to Arc at any time, with or without notice, if we believe you have violated these Terms, if required by law, or if we discontinue the App. If we terminate your account without cause, we will provide a pro-rated refund for any unused portion of a prepaid subscription period.
12.3 Effect of Termination
Upon termination, your licence to use Arc ceases immediately. Sections 8, 10, 11, and 14 survive termination.
13. Changes to These Terms
We may revise these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. For material changes, we will notify you through the App or by email. Your continued use of Arc after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using Arc.
14. General
- Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Arc regarding the Service and supersede any prior agreements.
- Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
- No Waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
- Assignment. You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights without restriction.
- Language. These Terms are written in English. Any translated version is provided for convenience only; the English version controls in case of conflict.
