1. Acceptance of Terms

These Terms of Use ("Terms") govern your use of the HeroTales mobile application ("App," "Service," or "HeroTales"). By downloading, installing, or using the App, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the App.

2. Eligibility and Parental Consent

2.1 Age Requirements

• HeroTales is designed for children ages 3-12
• The App must be used under parental supervision
• If you are under 18, you must have your parent or guardian's permission to use this App

2.2 Parental Consent

By allowing your child to use HeroTales, you (the parent or legal guardian) represent and warrant that:

• You are the parent or legal guardian of the child
• You have read and understand our Privacy Policy
• You consent to the collection and use of information as described in our Privacy Policy
• You will supervise your child's use of the App

3. Description of Service

HeroTales is an AI-powered storytelling application that:

• Generates personalized children's stories based on user-provided prompts using xAI (Grok API)
• Creates story illustrations using OpenAI DALL-E 3
• Allows users to optionally provide a photo to personalize the story character's appearance
• Adjusts story complexity based on the child's age (3-12 years)
• Stores all generated stories locally on your device

4. In-App Purchases and Subscriptions

4.1 Free Tier

HeroTales allows up to 4 story creations at no charge.

4.2 Premium Subscriptions

To create unlimited stories, you may purchase a premium subscription:

• Weekly subscription: Billed weekly through Apple's App Store
• Lifetime access: One-time purchase through Apple's App Store

All payments are processed by Apple. Prices are displayed in the App at the time of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.

4.3 Managing Subscriptions

You can manage or cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period. We do not offer refunds outside of Apple's standard refund policy.

4.4 Parental Controls

We strongly recommend that parents use Apple's Screen Time or Family Sharing features to control in-app purchase permissions for children.

5. License and Restrictions

5.1 License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use HeroTales for personal, non-commercial purposes, subject to these Terms.

5.2 Restrictions

You may NOT:

• Modify, reverse engineer, decompile, or disassemble the App
• Remove any copyright, trademark, or proprietary notices
• Use the App for any commercial purpose
• Redistribute, sell, or rent the App
• Use the App to generate content for publication or commercial use
• Attempt to extract or access the AI models or underlying technology
• Use the App in any way that violates applicable laws or regulations

6. User Responsibilities

6.1 Content Guidelines

When creating story prompts, you agree NOT to request content that is:

• Violent, graphic, or disturbing
• Sexual or inappropriate for children
• Hateful, discriminatory, or bullying
• Illegal or promoting illegal activities
• Infringing on intellectual property rights

Our AI content filters will reject inappropriate requests, but you are responsible for using the App appropriately.

6.2 Photo Use

By submitting a photo for story personalization, you represent and warrant that:

• You are the parent or legal guardian of the child in the photo
• You have the right to submit the photo for the purpose described
• The photo does not violate any third-party rights

6.3 Supervision

Parents and guardians are responsible for:

• Supervising their child's use of the App
• Reviewing generated stories for appropriateness
• Deciding whether to provide a photo for story personalization
• Teaching children safe and responsible technology use

7. Intellectual Property

7.1 App Ownership

HeroTales, including all software, design, graphics, and content, is owned by us and protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted are reserved.

7.2 Generated Stories

Stories generated by the App are created using AI technology:

• Your Input: You retain all rights to the prompts you provide
• Generated Content: AI-generated stories are for your personal use only
• No Commercial Use: You may not sell, publish, or commercially distribute generated stories without explicit permission
• Fair Use: You may share stories privately with family and friends for non-commercial purposes

7.3 User Content

By using the App, you represent and warrant that:

• You own or have rights to any photos you submit
• You have necessary permissions for any names or information you include
• Your prompts do not infringe on third-party rights

8. AI-Generated Content Disclaimer

You acknowledge and agree that:

• AI-generated stories may contain errors, inaccuracies, or inconsistencies
• We do not guarantee the quality, accuracy, or appropriateness of every generated story
• You should review all generated content before sharing with children
• We are not responsible for the educational or developmental impact of stories
• AI content is not a substitute for human-created literature or educational materials

9. Third-Party Services

The App uses the following third-party services. Your use of the App is subject to their respective terms and privacy policies:

• xAI (Grok API): For story text generation — xAI Terms
• OpenAI (Vision API & DALL-E 3): For photo analysis and story illustration generation — OpenAI Terms
• RevenueCat: For subscription and purchase management — RevenueCat Terms
• Apple App Store: For payment processing — Apple EULA

We are not responsible for third-party services' availability, content, or policies.

10. Privacy and Data Security

Please review our Privacy Policy to understand how we handle your child's information. Key points:

• All personal data (name, age, character descriptions, stories) is stored on your device
• If a photo is provided, it is sent to OpenAI for character trait analysis, then immediately deleted from your device
• Story prompts and character descriptions are sent to xAI and OpenAI to generate stories and illustrations
• Subscription receipts are managed by RevenueCat
• No analytics, tracking, or advertising

11. Disclaimers and Limitations of Liability

11.1 "As Is" Disclaimer

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

11.2 No Warranties

We do not warrant that:

• The App will be error-free or uninterrupted
• Defects will be corrected
• The App is free of viruses or harmful components
• Generated stories will meet your expectations
• The AI service will always be available

11.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the App
• Any content generated by the App
• Unauthorized access to your device or data
• Any bugs, viruses, or harmful code transmitted through the App
• Any errors or omissions in generated content

12. Indemnification

You agree to indemnify, defend, and hold harmless HeroTales, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Your prompts or content submitted to the App

13. Termination

13.1 By You

You may stop using the App at any time by deleting it from your device.

13.2 By Us

We reserve the right to:

• Suspend or terminate your access to the App for violation of these Terms
• Modify or discontinue the App at any time without notice
• Refuse service to anyone for any reason

13.3 Effect of Termination

Upon termination:

• Your license to use the App ends immediately
• You must delete the App from your device
• All locally stored data will remain on your device until you delete it

14. Updates and Changes

14.1 App Updates

We may release updates to improve functionality, fix bugs, or add features. You are responsible for keeping the App updated.

14.2 Terms Updates

We may modify these Terms at any time. When we do:

• We will update the "Last Updated" date
• We will notify you through the App if changes are material
• Your continued use constitutes acceptance of the new Terms

15. Geographic Restrictions

HeroTales is designed for global use. However, AI services may not be available in all countries. You are responsible for ensuring your use complies with local laws and regulations.

16. Governing Law and Dispute Resolution

16.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the United States and the State of California, without regard to conflict of law principles.

16.2 Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through:

• First, good faith negotiation between the parties
• If unresolved, binding arbitration in accordance with the American Arbitration Association rules
• Arbitration shall take place in California
• Each party bears its own costs and fees

16.3 Class Action Waiver

You agree to resolve disputes individually and waive any right to participate in a class action or representative proceeding.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and HeroTales regarding the App and supersede all prior agreements and understandings.

19. No Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

20. Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms without restriction.
